1. Looking for period

It is the period of responsibility to find the carrier. During the carrier’s liability period, if the goods are lost or damaged, the carrier shall be liable for compensation unless otherwise specified. That is to say, after the shipper proves the fact that the cargo is damaged and the cargo damage occurred during the carrier's liability period, the international shipping company must prove that there is an exemption or compensation limit. For example, as the carrier of international ocean moving services, if the goods are damaged in the hands of the distribution team, the loss should be borne by the carrier.


2. Find insurance

If an international shipping company is used to carry out an international move, and the insurance is purchased for the goods, the staff will do the following: notify the insurance company so that the cargo damage inspection and compensation procedures can be carried out, and the evidence of notification and communication will be retained. After the insurer pays the insurance compensation, he obtains the right of subrogation and claims compensation from a third party.


3. Find an inspection

The extent of the damage, the amount of the damage, and the cause of the damage are subject to inspection. Generally, the shipowner and the insurer appoint an inspector and issue a report respectively. The cargo owner can appoint an inspector if it feels necessary, for example, the value of the goods is large or there are objections to the inspection results. When cargo damage disputes reach the stage of litigation or arbitration, the court will comprehensively consider the inspection report to make a decision.


4. Find a claim

There may be more than one potential responsible person for cargo damage. You can choose to find the carrier based on the relationship of the transportation contract, or the insurer based on the relationship of the insurance contract, or the infringer based on the tort liability relationship. Considering factors such as contractual agreement, exemption circumstances, burden of proof, and ease of execution, I have also seen cases where all potential responsible persons are sued together.
